Terms of service

These terms cover using this website and buying from it. By placing an order you are agreeing to them, so please have a read. We have kept them as plain as we can.

Who you are buying from

You are buying from Mamma's Market LLC, a limited liability company formed in Arizona in May 2021 and run as a small handmade studio in Tucson. It does business as "Mammas Market" — that is the name on this site, on your order and on the parcel. Where these terms say "we" or "us", they mean Mamma's Market LLC. Where they say "you", they mean you.

Everything here is made by hand

Every piece is made individually, in small batches, by a person. Small differences in color, size, texture, glaze, and finish between one piece and the photograph are normal and expected — they are the mark of a handmade object, not a flaw. Photographs also show color differently on different screens. If a piece arrives genuinely wrong or damaged, that is a different matter and we will sort it out.

Using these pieces safely

Some of our pieces — the diffuser pendants and bracelets — are made to hold essential oils and are worn against skin. Essential oils are potent, and skin reacts to them differently from person to person.

  • Patch-test first. Put a small amount of a diluted oil on the inside of your forearm and wait a day before wearing a piece against skin for any length of time.
  • Stop if your skin reacts — redness, itching, burning or a rash — and wash the area. See a doctor if it does not settle.
  • Keep oils off broken, irritated or sunburnt skin. Some oils, citrus ones especially, can make skin more sensitive to sunlight.
  • Not for children, and please keep oils and small pieces away from them and from pets.
  • If you are pregnant or nursing, or taking medication, talk to your doctor before using essential oils.
  • Natural fibres — wool, mohair, silk blends — can irritate sensitive skin. If you know you react to a fibre, check the product description before ordering.

We sell handmade objects, not medical products. Nothing here is a treatment for any condition, and none of it is a substitute for advice from a doctor.

One-of-a-kind pieces and your cart

Most pieces exist exactly once. Putting one in your cart does not hold it for you — the piece is only set aside once you start checkout, and it stays set aside for about 35 minutes while you pay. If someone else buys it first, we will tell you at checkout rather than take your money for something we cannot send.

If a one-of-a-kind piece has already sold, some listings offer a remake request. That is described further down.

Placing an order

Placing an order is an offer to buy. We accept it when we take your payment — that is the moment the order becomes a contract, whether or not the confirmation email reaches you. Before payment we may decline the order: if the piece turns out to be unavailable, if the listing had an error, or if the order looks fraudulent. If we cancel after you have paid, we refund you in full. If your confirmation email does not arrive, that does not undo your order — tell us and we will resend it.

Prices and mistakes

Prices are in US dollars. Sales tax is worked out at checkout from your shipping address, and you will see the full total — item, shipping, and tax — before you pay. We can change prices at any time, but a change never affects an order we have already accepted.

Sometimes a discount code is offered. If one is active you can enter it at checkout. And occasionally a price or description is simply wrong. If an obvious error slips through, we may cancel the affected order and refund you rather than honor it.

Shipping and delivery

We ship within the United States only. Shipping is a flat rate for the order, and it is waived once your order passes the free-shipping amount. A few larger or heavier pieces carry their own shipping price instead; that price is not waived by the free-shipping amount, and if you buy more than one of the same piece, the extra ones ship at a lower rate because they travel in the same box. Whatever the total works out to, you see it at checkout before you pay.

In-stock pieces usually ship within 2–5 business days. Made-to-order pieces take a little longer — the estimate is shown right on the product page. We email you a tracking number as soon as your order ships.

If we can't ship within that window, we'll email you before it is up with a new date, and you can choose to wait or take a full refund.

Once a parcel is with the carrier, how quickly it moves is out of our hands. If a parcel is lost or arrives damaged, tell us and we will help you put it right.

Returns

Our full policy lives on the Returns and exchanges page, and that page is the one that governs.

You can return most items in their original, unused condition within 30 days of delivery for a refund. Reach out first and we'll walk you through it. Return shipping is paid by you, unless the piece arrived damaged or wasn't what you ordered — then it's on us.

Because these are made individually, one-of-a-kind and custom made-to-order pieces are final sale — but if a piece arrives damaged, we'll always make it right. If your order arrives damaged, message us within 1 day of delivery with a photo and we'll replace it or refund you.

Remake requests

When a one-of-a-kind piece has sold, you can sometimes ask for another to be made. Your card is saved at that point but not charged. The owner then accepts or declines the request. If she accepts, your card is charged and the piece goes into the making queue. If she declines, nothing is charged and the saved card is released. If a request sits undecided for 21 days it cancels itself, nothing is charged, and we let you know.

A remade piece is made fresh by hand. It will be a sibling of the original, not a duplicate of it.

Reviews

If you leave a review, it goes to the owner first and appears on the site only after she approves it. By posting one you are telling us it is your own honest experience, and you are giving us permission to show it on the site under the name you entered, including trimming it for length.

Please do not post:

  • anything false, or a review of a piece you did not buy or receive;
  • someone else's personal information, or your own private details;
  • abuse, harassment, hate, or threats;
  • advertising, links, or spam;
  • anything that is not yours to post, or that breaks the law.

We can decline, edit, or remove any review, at any time, for any of the reasons above. We do not remove a review just because it is critical.

Photographs, words, and the site itself

The product photographs, the descriptions, the shop name, and the design of this site belong to us. You are welcome to browse, share a link, and save what you need for your own personal use. Please do not copy the photographs or descriptions for another shop or listing, scrape the site, or use our name or images to sell anything.

Using the site fairly

Please use the site the way it was meant to be used. Do not try to break into it or into anyone's account, do not scrape it automatically, do not flood the contact form, the newsletter, the reviews, or the waitlist, and do not place orders under someone else's identity or payment details. We may refuse service or cancel an order if any of that is happening.

What we do and do not promise

We make each piece with care and describe it as honestly as we can. Beyond that, everything on this site is offered as it is. We cannot promise the site will always be available or error-free, that a piece will be an exact match for its photograph, or that a handmade object will suit every use you have in mind. Care instructions are noted on the product page where they matter — please follow them.

If something goes wrong

If we get an order wrong, our responsibility is to put that order right — by replacing the piece or refunding what you paid for it. Our total responsibility to you for any order is limited to what you paid for the items that order concerned.

We are not responsible for indirect or knock-on losses — lost time, lost profit, a missed occasion, or the cost of arranging something else — even if we were told those things mattered.

Nothing in these terms limits anything that cannot lawfully be limited. That includes death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, gross negligence, and any right you have under consumer-protection law that a seller is not permitted to take away. Where a term of this section is not enforceable where you live, the rest of it still applies.

Which law applies, and how disagreements are handled

These terms, and any dispute arising out of them or out of anything you buy here, are governed by the laws of the State of Arizona, without regard to its conflict-of-laws rules. Mamma's Market LLC is an Arizona company.

If we cannot sort something out between us, any dispute goes to the state courts of Pima County, Arizona — the studio is in Tucson, which is in Pima County; the Phoenix address above is a mailing address only — and you and we both agree that is where it is heard. Either of us may still use small claims court instead — for most disagreements about an order that is the faster and cheaper route, and we would rather you had it. We do not require arbitration.

Changes to these terms

We may update these terms. When we do, we will change the date at the bottom of this page, and the version in force for your order is the one that was posted when you placed it.
